Arman Shakkaliev: "Soft regulation tools that are new for the EAEU law prove their efficiency and relevance"

In 2022, the Commission has issued six warnings about the need to eliminate the signs of violating the general rules of competition in transboundary markets without administrative sanctions. A half of them have already been fully implemented in the markets of water purification equipment, tea as well as mobile device applications for the location tracking of minors.

In addition, the EEC has issued four admonitions in connection with public statements made by officials of the Union countries' economic entities on the planned possible anti-competitive behavior. The admonitions concern markets of medical and tourist services.

During the meeting of heads of antitrust authorities in the "5+1" format, Arman Shakkaliev, EEC Minister in charge of Competition and Antimonopoly Regulation, has informed about the implementation of new soft regulation tools, the improvement of the EAEU law in the field of competition and priority areas in the activities of the Commission's Competition Unit. The event has taken place on May 25 in Bishkek on the premises of the Antitrust Regulation Service under the Ministry of Economy and Commerce of the Kyrgyz Republic.

It bears reminding that new soft law tools – warning and admonition – were introduced as part of improving the EAEU law in 2021. They are intended to remove causes, conditions and consequences of anti-competitive behavior by transboundary market players, minimize human and time costs, restore equal competition conditions without penalties, as well as admonish against actions that may entail violating the Treaty on the EAEU.

In turn, heads of antitrust authorities have informed their colleagues of the ongoing work to implement measures for the improvement of the sustainability of the EAEU States' economies, the improvement of national legislation in the sphere of competition protection and the state regulation of prices for socially relevant goods.
