EAEU approved rules for filing applications on control measures

At its meeting held on August 1, the Eurasian Economic Commission's Council approved the Procedure for consideration by the Eurasian Economic Commission of an application from the Eurasian Economic Union Member State on the validity of measures taken by the state control (supervision) body of another Member State in relation to products that do not comply with the requirements of the Union's technical regulations.

The Procedure establishes a mechanism for considering and settling disputes following the state supervision arising between the Eurasian Economic Union Member States.

It will be ensured that the reasonability of administrative response measures to satisfy the requirements of the Union's technical regulations will be considered on the basis of verified expert recommendations.

This will be a soft, pre-trial mechanism for combating inappropriate law enforcement practices.

The decision adopted following consideration of the application will be used to ensure a unified approach to measures taken in the sphere of state control over products which do not comply with the requirements of the Union's technical regulations.

The EEC Council's decision was adopted as part of implementing Paragraph 3, Article 9 of the Agreement on the principles and approaches of state control (supervision) over compliance with the requirements of the Eurasian Economic Union's technical regulations to harmonize the legislation of the Eurasian Economic Union Member States in this field dated February 16, 2021 and Paragraph 4.7.3 of the Strategic Directions for Developing the Eurasian Economic Integration until 2025, approved by Decision No. 12 of the Supreme Eurasian Economic Council dated December 11, 2020.
