Rules for determining country of origin of industrial goods for public procurement purposes amended

Important amendments to the Rules for Determining the Country of Origin of Certain Goods for Public Procurement Purposes have been made today by the decision of the EEC Council. From now on, the criteria of origin established in the Rules for determining the country of origin in the Commonwealth of Independent States signed on November 20, 2009 will be applied to certain types of light industry goods, paper and trolleybuses to determine their country of origin.

In addition, it was decided that for being entered in the Eurasian Register, a manufacturer will have to provide the ST-1 certificate of origin.

Some amendments were also introduced to Annex No. 1 to the Rules for Determining the Country of Origin. They are related to the practice of applying the Rules and are necessary for making clarifications in the names of some commodity items.

For example, the name "Turning, boring and milling metal-cutting machines" specified in Annex No. 1 to the Rules does not cover all types of machine tools for which the manufacturing environment is established. This name also includes machines for roughing and grinding, sharpening, grinding, honing, lapping, polishing and for performing other operations of finishing metals or cermets using grinding stones, abrasives or polishing agents, except for gear cutting, gear grinding or gear finishing machines.

Some amendments are related to the new version of the common Commodity Nomenclature for Foreign Economic Activities of the EAEU approved by Decision No. 80 of the Commission's Council dated September 14, 2021 and introduced on January 1, 2022. It provides that trucks will be classified in the EAEU CN FEA codes 8701 21, 8701 22, 8701 23, 8701 24, 8701 29. The code that exists in the current revision of Annex No. 1 will be excluded next year.
