Representatives of EAEU countries' competent authorities discussed general principles and approaches to establishing legal liability for violations of customs rules

At the first meeting of the profile working group chaired by Minister in charge of Customs Cooperation of the Eurasian Economic Commission Maksat Mamytkanov, representatives of the authorized bodies of the EAEU countries, whose competence includes law enforcement in the field of customs regulation, discussed general legal approaches to holding persons accountable for violations of customs rules.

  This task is enshrined in the Strategy 2025 and should be implemented by countries in the medium term.

Legal relations in the field of customs regulation are maximally unified and regulated by the Customs Code of the EAEU and acts adopted in its development. The Customs Code of the EAEU establishes the obligations of persons performing customs operations, failure to comply with which should entail liability under the national legislation of the Union countries.

"At the present development stage of integration processes, there is a need to build a system of protective norms of a single model, providing for general principles and approaches to establishing legal liability for similar offenses on the territory of any of the EAEU Member States," said Maksat Mamytkanov.

 

Among the topics discussed are the development of approaches to organizing interaction between the EEC and the competent authorities of the EAEU states, the organization of thematic expert consultations and the preparation of proposals for fixing the general principles and approaches to establishing such responsibility in the law of the EAEU.

Clause 3.1.6 of the Strategic Directions for Developing the Eurasian Economic Integration until 2025, approved by Decision No. 12 of the Supreme Eurasian Economic Council dated December 11, 2020, provides for making amendments to the Treaty on the Specifics of Criminal and Administrative Liability for Violations of the Customs Legislation of the Customs Union and the Member States of the CU dated July 5, 2010 in terms of defining principles and approaches common to all to establishing liability for non-compliance with the requirements of the Union law in the field of customs regulation.
