Transitional provisions for certain requirements of technical regulations on safety of packaged drinking water and perfume and cosmetic products established

The Eurasian Economic Commission’s Board approved the procedure for enforcing certain requirements of the Union’s Technical Regulation "On safety of packaged drinking water, including natural mineral water".

Transitional provisions have been established whereby documents on state registration of products for which previously adopted requirements come into effect from January 1, 2022* apply until December 31, 2022. This will ensure a smooth transition of manufacturers to new requirements.

Along with that, until December 31, 2022, only research (testing) protocols of these products for compliance with new requirements are used to reissue state registration documents without presenting research results provided for by the technical regulation in full.

Besides, the deadline has been set – December 31, 2022, before which the manufacture and release into circulation of packaged drinking water is allowed without regard to such requirements – as it was manufactured prior to including test methods in the lists.

The circulation of such products is allowed during the expiry date established by its manufacturer.

Declarations of conformity shall not be reissued, since when amending mandatory requirements evidentiary materials (test reports, etc.) should be amended in terms of confirming compliance with such requirements in accordance with the "horizontal" Technical Regulation "On food safety", while the adoption of new declaration of conformity is not required (Part 11 of Article 23 of the Technical Regulation).

Furthermore, the Eurasian Economic Commission’s Board clarified the procedure for introducing amendments to the Technical Regulation "On safety of perfume and cosmetic products".

Now it is provided that when replacing documents on state registration of perfume and cosmetic products issued prior to enacting these amendments, i.e. until May 5, 2020, such documents shall be valid up to and including May 5, 2023 in cases provided for in Paragraph 251 of the Rules for issuing certificates of state registration of products, for example, when typos are found or addresses are changed.

*Certain requirements of the Technical Regulation "On safety of packaged drinking water, including natural mineral water" will come into effect since January 1, 2022, in particular Annexes No. 2 (indicator "Total Bacterial Count at 22 °C" of Table 2) and Annexes No. 3 to the Technical Regulation (items 1 of Section I (indicator "Total Bacterial Count at 22 °C") and Section II (indicators "Cryptosporidium Oocysts", "Giardia Cysts" and "Helminth Eggs") of Table 2) amid including relevant test methods for such indicators in the lists of standards to the Technical Regulation.
