Phytosanitary Measures
1. What are the normative documents of the Customs Union and the Common Economic Space, which regulate the quarantine phytosanitary control (supervision) at the customs border of the Customs Union and customs territory of the Customs Union?
Answer:
The quarantine phytosanitary control (supervision) at the customs border of the Customs Union and customs territory of the Customs Union is realized in accordance with the following:
Customs Union Agreement on Plants Quarantine of December 11, 2009;
Regulation on Procedure of Phytosanitary Control (Supervision) at the Customs Border of the Customs Union;
Regulation on Procedure of Phytosanitary Control (Supervision) within the Customs Territory of the Customs Union;
List of Goods under Quarantine (cargo, materials, commodities under quarantine), Subject to Phytosanitary Control (Supervision) at the Customs Border of the Customs Union and within the Customs Territory of the Customs Union.
2. What document on pants quarantine are being developed at the time?
Answer.
At the present time we have developed the Draft Protocol on Amendment in the Customs Union Agreement on Plants Quarantine of December 11, 2009, as it related to the authority of the Eurasian Economic Commission to approve the Common List of Quarantine Objects of the Customs Union and the Common List of Phytosanitary Requirements of the Customs Union. The draft has passed the intrastate approval procedure in the Republic of Belarus and the Republic of Kazakhstan. The Russian Federation has not yet completed the task.
The following drafts has been developed:
- The Common List of Quarantine Objects of the Customs Union;
- The Common List of Phytosanitary Requirements.
Amendments and additions are also being introduced into the Regulation on Procedure of Quarantine Phytosanitary Control (Supervision) on customs border of the Customs Union. The new version of the Regulation on Procedure of Quarantine Phytosanitary Control (Supervision) on customs border of the Customs Union is under preparation.
The mentioned documents are necessary for deepening of the integration processes, for elimination of administrative barriers, and for supporting of the phytosanitary safety within the Customs Union territory.
3. What plant-based goods are subject to the phytosanitary control (supervision)?
Answer:
Goods under Quarantine, enlisted in the List of Goods under Quarantine (cargo, materials, commodities under quarantine), Subject to Phytosanitary Control (Supervision) at the Customs Border of the Customs Union and within the Customs Territory of the Customs Union, approved by the Decision of the Customs Union Commission No. 318 of June 18, 2010 “On Plants Quarantine Provision within the Customs Union”, are subject to phytosanitary control (supervision).
4. Каким образом построена работа по гармонизации законодательства в области карантина растений Таможенного союза и Единого экономического пространства с международным законодательством в этой сфере?
Ответ.
Гармонизация законодательства в области карантина растений Таможенного союза и Единого экономического пространства с международным законодательством в сфере фитосанитарных мер, осуществляется путем изучения мирового законодательства и практики национальных организаций по карантину и защите растений зарубежных стран, а также непосредственным участием сотрудников отдела фитосанитарных мер в международных переговорах, семинарах по разработке новых и пересмотру существующих международных и региональных стандартов по фитосанитарным мерам, организованных Европейской и Средиземноморской организацией по карантину и защите растений (ЕОКЗР), совместно с Продовольственной и сельскохозяйственной организацией Объединённых Наций (ФАО) и Секретариатом Международной конвенции по карантину и защиту растений (МККЗР).
5. О переносе подкарантинной продукции (кофе нежареного с кофеином или без кофеина, коллекции и предметы коллекцирования по зоологии, ботанике, муки) из группы высокого фитосанитарного риска Перечня подкарантинной продукции (подкарантинных грузов, подкарантинных материалов, подкарантинных товаров), подлежащей карантинному фитосанитарному контролю (надзору) на таможенной границе Таможенного союза и таможенной территории Таможенного союза (далее – Перечень подкарантинной продукции) в группу с низким фитосанитарным риском.
Ответ.
Указанный вопрос был рассмотрен на заседаниях рабочей группы по направлению «Фитосанитарные меры» 23-25 апреля и 25-27 июня 2013 года. Эксперты государств – членов Таможенного союза не выработали согласованной позиции по указанному вопросу. Продолжается работа по актуализации Перечня подкарантинной продукции и проведение научными учреждениями государств – членов Таможенного союза научного обоснования по внесению изменений в Перечень подкарантинной продукции.
