Enforcement Proceedings Initiated following Decisions by EEC Board
The Eurasian Economic Commission received information from the Federal Bailiff Service (FSSP), according to which the Bailiff Department in Ordzhonikidze District of Magnitogorsk of the Main Directorate of the FSSP of Russia for Chelyabinsk region initiated enforcement proceedings No. 315086/24/74059-IP in respect of OOO Magnitogorsk Chemical Reagents Plant (MCRP) and enforcement proceedings No. 315088/24/74059-IP against its General Director (for the purpose of compulsory collection of fines imposed by the Commission).
It bears reminding that on March 19, 2024 the EEC Board adopted Decision No. 24 On Imposing Fines for Failure to Provide Data (Information). The actions of OOO MCRP and its General Director, consisting in the failure to provide information at the request of the Commission, recognized as a violation of the provisions of paragraph 13 of the relevant Protocol of the Eurasian Economic Union legislation, liability for which is provided for in paragraph 16, subparagraph 5 of the said document.
In addition, the Commission received information from the Federal Bailiff Service on the initiation of enforcement proceedings in the Turinsk District Bailiff Department of the Main Directorate of the Federal Bailiff Service of Russia for Sverdlovsk region No. 166403/24/66057-IP against AO Turinsk Pulp and Paper Plant and the head of OOO TURA Managing Company. A similar communication came from the Bailiff Department in Dzerzhinskiy District of Perm of the Main Department of the Federal Bailiff Service of Russia for Perm Territory — enforcement proceedings No. 270391/24/59050-IP were initiated against OOO TURA Managing Company (in both cases also for the purpose of compulsory collection of fines imposed by the Commission).
In this regard, it bears reminding that on September 19, 2023, the Board of the Commission by Decision No. 142 On Imposing Penalties for Non-Submission of Data (Information) recognized the actions of AO Turinsk Pulp and Paper Plant, OOO TURA Managing Company and its head as a violation of the same norms of the Union legislation.
