26 Mar 2024 EEC hold discussions with Belarusian businesses on public procurement and competition in EAEU cross-border markets Problematic issues of competition and public procurement were discussed by the participants of the Public Information Office held at the Brest Regional Executive Committee with the support of the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus. The meeting was led by Maxim Ermolovich, Minister in charge of Competition and Antitrust Regulation of the Eurasian Economic Commission. "More than 80 percent of entrepreneurs and consumers believe that Eurasian markets are highly competitive. Competitive economy brings advantages and replaces strict state regulation," Maxim Ermolovich noted.  Representatives of Belarusian businesses also touched upon the topics of technical regulation, protection of domestic markets, labeling of goods and others. Within the framework of the Public Information Office individual consultations were held, where EEC experts answered business questions one-on-one and gave clarifications to address them. According to Maxim Ermolovich, there was an open dialog with business representatives, "In the Commission, we consider the Public Information Office as a certain source of information about competition violations. Businesses are concerned not only about competition and public procurement, but also about other areas of EEC activity. Our colleagues and we will answer all questions." The event was attended by representatives of business, the Ministry of Antimonopoly Regulation and Trade of Belarus, the Brest Regional Executive Committee, specialized EEC units, deputies of the House of Representatives of the National Assembly of Belarus. EAEU improves approaches to reporting in public procurement 01 Mar 2024 EAEU improves approaches to reporting in public procurement Relevant issues of collecting and generating reports in the field of public (municipal) procurement, including the adoption of methodical recommendations for its collection and generation, were considered at the meeting involving representatives of authorized bodies of the Eurasian Economic Union in the field of public procurement, chaired by Zhanar Adikova, Director of the Department for Competition and Public Procurement Policy of the Eurasian Economic Commission. Due to completed ratification by the EAEU Member States of the Second Major Protocol amending the Treaty on the EAEU, the generation of reporting in the field of public (municipal) procurement in the EAEU Member States becomes mandatory as from 2024. During 2015-2023, such report generation was non-binding. Annual reviews "Public (Municipal) Procurement of the Eurasian Economic Union Member States (Analysis of Reporting Indicators)" are available on the Eurasian Economic Commission's portal. 25 indicators have been determined, including, for example, the number of procurement procedures conducted, bids submitted and contracts concluded in terms of procurement methods, including electronic ones, the value of concluded contracts by source of financing, procurement methods, country of origin of goods, works and services and country of registration of suppliers. Reporting by type of goods, works and services and country of origin is introduced for the first time. For reference The Protocol on amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014, signed on March 31, 2022, envisages an amendment to Paragraph 29 of Annex No. 25 to the Treaty on the Eurasian Economic Union stating that the EAEU Member States shall ensure information openness and transparency of procurement, including through the generation of information (reporting) in the field of public (municipal) procurement, including on indicators and formats approved by the Commission. The indicators and reporting formats were approved by Decision No. 179 of the Eurasian Economic Commission's Board dated December 29, 2023 (section 27 of the list of indicators, formats F27.01.01 and F27.01.04, F27.02.01 and F27.02.04). Recommendation No. 26 of the Eurasian Economic Commission's Board dated November 3, 2015.
01 Mar 2024 EEC Council adopted a set of amendments to EAEU competition law At the meeting of the Eurasian Economic Commission's Council on March 1, amendments were made to the acts regulating the procedure for monitoring compliance with the general rules of competition in transboundary markets, such as the Procedure for Considering Applications, Conducting Investigations, Considering Cases and Technique for Fines and Assessing the State of Competition. Statements regarding violations of the general rules of competition in transboundary markets can now be submitted to the Commission in any official language of a country of the Eurasian Economic Union with mandatory translation into Russian. The procedure for certifying such a translation has been simplified. An additional ground for terminating the investigation is included: the presence of a final decision of the Commission's Board in the case of violation of the general rules of competition in transboundary markets in relation to the same persons, on the same basis and subject. In addition, the dispute over what constitutes the day of discovery of a continuing violation has been put to rest. This day is now defined as the date of issuing the decision to conduct an investigation. This is necessary to calculate the statute of limitations for prosecution. The amendments also affect the Technique for Assessing the State of Competition in terms of market analysis when considering signs of unfair competition. From now on, within the framework of investigations, the determination of the composition of business entities may be limited to establishing the applicant, the violator and their competitive relations.
