EEC Council instructed to amend EAEU law regarding assessment of competition state in digital markets

On October 5, the EEC Council instructed the Commission, jointly with the Governments of the EAEU countries, to prepare relevant amendments to the Union’s law in order to improve the assessment of competition in digital markets of the Eurasian Economic Council countries as well as to delineate powers between competition authorities of the Member States and the Commission.

According to the instruction, the amendments will affect the specifics of determining the product and geographical boundaries of digital markets, calculating the volume and shares of economic entities in them and assessing factors of possible barriers to enter the market.

Besides, in order to confirm the Commission’s powers to consider violations of general competition rules, some procedure and practices for preparing an analytical report on the compliance of a particular commodity market with the Criteria for classifying the market as transboundary one will be determined. In order to implement such an algorithm, amendments should be made to the Methodology for assessing the state of competition, the Procedure for considering applications for violations of general competition rules in transboundary markets and the Procedure for investigating violations of general competition rules in transboundary markets.

"We plan to work on implementing the Council's instruction this year - in the first half of next year. This issue will be reported at the EEC Council’s meeting in July 2022", commented Arman Shakkaliev, EEC Minister in charge of Competition and Antitrust Regulation.
