General information

Prior to signing of the Treaty on the Eurasian Economic Union dated May 29, 2014 (hereinafter referred to as the "Treaty"), the activities of Natural Monopolies Section were based on the provisions and norms of the Agreement on the unified principles and rules of regulation of the activities of natural monopoly entities dated December 9, 2010 (hereinafter referred to as the “Agreement”).

Subsequently, all provisions of the Agreement were incorporated into the Treaty, including general principles, types and methods of regulation of the activities of natural monopoly entities, rules for providing natural monopolies with access to services, competences of the Eurasian Economic Commission (hereinafter referred to as the “Commission”). The following provisions of the Agreement, implemented in 2012-2013, were not included into the Treaty:

- Phased Plan for the formation of the Single Economic Space with respect to the spheres of natural monopolies (from the sector (industry) perspective) approved by Decision No. 14 of the Board of the Commission dated February 5, 2013 (Annex 1); 

- Monitoring criteria and procedure for implementation of the Phased Plan approved by Decision No. 14 of the Board of the Commission dated February 5, 2013 (Annex 2).


Responsibilities of the Commission for natural monopolies within the framework of the Treaty (for the period from January 2012 to May 2014):

- preparation of proposals on the Phased plan;

- preparation of proposals on criteria and monitoring procedures of the Phased plan implementation;

- analysis and elaboration of proposals on ways of coordination (development and implementation) of the national bodies’ decisions relating to natural monopolies;

- performance of a comparative analysis of the system and practices in the sphere of regulation of the activities of natural monopoly entities in the Member States providing preparation of related annual reports and statements;

- promotion of regulation harmonization in the spheres of natural monopolies with respect to environmental aspects, energy efficiency;

- presentation of results of the performed work on implementation of the Treaty for consideration by the Interstate Council of the Eurasian Economic Community (Supreme governing body of the Customs Union);

- preparation of proposals on the list of regulatory legal acts of the Parties in the sphere of natural monopolies subject to harmonisation, established by the Interstate Council of the Eurasian Economic Community (Supreme governing body of the Customs Union).

Responsibilities of the Commission for natural monopolies within the framework of the Treaty (since May 2014):

- decision-making on expansion of the spheres of natural monopolies in the Member States (after submission of a relevant request to the Commission);

- performance of a comparative analysis of the system and practices in the sphere of regulation of the activities of natural monopoly entities in the Member States providing preparation of related annual reports and statements;

- promotion of regulation harmonization in the spheres of natural monopolies with respect to environmental aspects, energy efficiency;

- preparation of materials on results of the performed work coordinated with the Member States’ national authorities for consideration by the Supreme Eurasian Economic Council, as well as proposals on introduction of regulatory legal acts in the sphere of natural monopolies subject to harmonisation coordinated with the Member States, and proposals on determination of the sequence of implementation of relevant measures to harmonize legislation in this sphere.​
