EEC Council Adopted Amendments to Technical Regulation On Perfume and Cosmetic Products

The Eurasian Economic Commission's Council adopted amendments to the Technical Regulation "On Safety of Perfume and Cosmetic Products."

It clarifies the scope of the technical regulation in relation to perfume and cosmetic products applied to various items. This norm covers, for example, moisturizing cream applied to baby diapers or anti-cellulite treatment for jeans.

The conceptual framework of the technical regulation is updated. There is a possibility of toxicity assessment of perfume and cosmetic products based on the analysis of toxicological profile of their ingredients by calculation without the use of laboratory animals.

For oral hygiene product packaging, there is a requirement for tamper-proof seals.

A ban is also introduced on the use of trade names of registered medicines or medical devices in the names of perfume and cosmetic products.

The schemes and procedures for state registration and declaration of conformity of perfume and cosmetic products established in the technical regulation have been brought in accordance with the approved standard schemes of conformity assessment taking into account the practice of applying the technical regulation.

Once the amendments come into effect, they will have a positive impact on both consumers and producers. The amendments set forth unambiguous requirements in cases where there was a need for clarification. For example, in terms of family cosmetics there were many questions and differences of opinion: whether it was necessary to apply requirements to such products as to children's products, because there may be children in the family. The amendments stipulate that it is mandatory for the packaging of family cosmetics to indicate the minimum age of users, depending on which requirements will apply.

The amendments will come into effect after one year has elapsed from their official publication except for certain provisions.

Transitional provisions of the amendments to the technical regulation will be determined by a separate decision of the EEC Board.
