Without a common competition policy – policy that is not the same but based on common approaches – it is impossible to harmonize the other elements of the common economy. The unified competition policy includes antimonopoly regulation, price regulation including control over the introduction of state price regulation, as well as state and municipal procurement. Any country has its monopolists, and if the problems can be solved at the state level, then importers from the CES countries may need other regulations ensuring equal market access..

The first legal and organizational framework was determined for the Customs Union back in the second half of the 90s, when Belarus, Kazakhstan, and Russia approved the Agreement on the Customs Unions of January 6, 1995, the Agreement on the Customs Unions of January 20, 1995, and the Agreement on the Customs Union and the Common Economic Space of February 26, 1999, the documents generally having a declarative nature.
