The Department for Internal Market Functioning (hereinafter the Department) is a structural subdivision of the Eurasian Economic Commission (hereinafter the Commission) ensuring the Commission's activities in the field of functioning of the internal market for goods, services, capital and labor resources within the Eurasian Economic Union.


The Regulation on the Department was approved by Order No. 108 of the Chairman of the Commission's Board dated April 25, 2023.


The main objectives of the Department are:

1) participation in developing draft international treaties and other draft legal acts of the Union's governing bodies as far as the Department's jurisdiction applies;

2) development of proposals on creating mechanisms for identifying obstacles in the internal market and monitoring their elimination (including mechanisms involving information technologies) specifically in interaction with public authorities, local (self-government) authorities, business communities, public associations, natural persons of Member States, as well as advisory bodies and structural subdivisions of the Commission (hereinafter "interested persons");

3) identification of obstacles in the internal market and monitoring of their elimination using the mechanisms specified in subparagraph 2 herein;

4) together with interested persons, development of proposals aimed at elimination, reduction and (or) minimization of the identified obstacles in the internal market;

5) preparation of proposals on addressing systemic problems of internal market functioning;

6) development of strategic documents in the field of internal market functioning;

7) analysis of internal market development and generation of proposals on its further strategic development;

8) ensuring exchange of information with interested persons on the issues of identifying and monitoring elimination of obstacles in the internal market;

9) generation of proposals on establishing bilateral and multilateral cooperation in the field of internal market functioning with international and regional organizations and integration associations;

10) generation of proposals on improvements in dispute settlement (mediation) procedures.

    
The Department performs the following functions:

1) prepares materials and draft acts by the Union's governing bodies on the issues of internal market functioning for consideration by the Commission's Board members;

2) prepares proposals on concluding international treaties and amending them, ensures development of draft international treaties stipulating regulations aimed at ensuring internal market functioning without obstacles;

3) creates and maintains electronic information systems allowing to generate databases on obstacles together with interested persons, ensures that such databases function and are used by the Commission and interested persons;

4) ensures that the received appeals are reviewed in accordance with the procedure for reviewing appeals on obstacles established by the Commission;

5) ensures maintenance of the information portal "Internal Market Functioning in the Territory of the Eurasian Economic Union" (hereinafter "information portal") allowing economic entities and other interested persons to report information on obstacles to the Commission;

6) if required, develops and applies internal market analysis tools;

7) monitors the internal market functioning with the aim of identifying obstacles;

8) prepares draft acts of the Union's governing bodies regulating the activities to identify and eliminate obstacles in the internal market and proposals on their improvement;

9) prepares opinions on the presence or absence of signs of obstacles in the internal market in cooperation with Member States, the Commission's structural subdivisions and other interested persons;

10) prepares proposals for removing obstacles in the internal market according to the information on the results of monitoring internal market functioning, including proposals for developing action plans ("road maps") on removing obstacles in the internal market in cooperation with interested persons;

11) coordinates and monitors the implementation of actions provided for by action plans ("road maps") on removing obstacles in the internal market;

12) prepares analytical materials on systemic problems of internal market functioning;

13) develops principles, methods and mechanisms, as well as establishes a regulatory framework for settling disputes (mediation) arising from ensuring internal market functioning and from identifying any specific evidence (cases) of barriers;

14) prepares materials for settling disputes specified in subparagraph 13 herein in the pretrial order by means of consultations and negotiations as well as by other means provided for by the Treaty and international treaties within the Union;

15) ensures development of strategic documents in the field of internal market functioning;

16) prepares proposals on improving, harmonizing and (or) unifying legislation of Member States on the issues related on internal market functioning and creating conditions for free movement of goods, services, capital and labor resources within the Union;

17) ensures development of recommendations regarding law enforcement practice of Member States;

18) ensures that public authorities of Member States make public awareness efforts on the issues within the Department's jurisdiction;

19) participates in conducting regulatory impact assessment of the Commission's draft decisions and actual impact assessment of decisions adopted by the Commission on issues within the Department's jurisdiction;

20) prepares proposals on ensuring free movement of goods, services, capital and labor resources of the Union;

21) monitors how Member States implement provisions of the Treaty, international treaties and instruments constituting the Union law, as well as monitors the compliance of draft regulatory legal acts of Member States with provisions of the Treaty, international treaties and instruments constituting the Union law for the purpose of identifying obstacles independently at its own initiative or on the basis of information on obstacles available from Member States, the Commission's structural subdivisions, as well as legal and natural persons;

22) prepares proposals to notify Member States on the identified obstacles and monitors activities aimed at their elimination;

23) subject to availability of required information, analyzes economic effects of obstacles;

24) prepares reports and other information materials in the areas of Department's activities for consideration at the sessions of the Union's governing bodies;

25) ensures that interested persons are informed about removing obstacles;

26) prepares proposals on creating advisory bodies;

27) provides organizational support of activities carried out by the advisory body (bodies) on issues within the Department's jurisdiction;

28) develops and submits proposals on issues within the Department’s jurisdiction to be included in the plan of the Commission’s research activities;

29) arranges the research process on identifying obstacles using various methods of analysis (studies, surveys, test purchase mechanisms and other methods);

30) interacts with the Commission’s structural subdivisions and public authorities of Member States on the issues within the Department's jurisdiction;

31) participates in organizing and contributing to conferences, seminars and other events on the issues within the Department's jurisdiction;

32) prepares analytical and reference materials for consideration by the Members of the Commission's Board and the Commission's Council;

33) performs other functions within its jurisdiction.

• Section of Planning and Analysis of Internal Market Functioning;

• Section of Expertise and Mediation;

• Section of Strategic Development of Internal Market.
